Who has to register the lease — the landlord or the tenant?

The landlord. Registration is a legal obligation that falls on the property owner. A tenant may register the lease themselves — it is free for them too — but they are never obliged to. In practice, treat it as part of moving a new tenant in: sign the lease, draw up the move-in inspection, register both.

What is the deadline to register a lease in Belgium?

Two months from the date the lease is signed. For a main-residence lease registered within that window, registration costs nothing. Register late and the residential lease itself stays free, but you expose yourself to a late-filing fine (in the order of €50) and, far more importantly, to the exit right described below.

Is registering a lease free in Belgium?

Yes, for a main-residence lease filed on time. The move-in inspection report (état des lieux / plaatsbeschrijving) can — and should — be registered together with the lease, also free of charge. Registering it protects both sides if there is ever a dispute over the deposit at move-out.

How do you register a lease? (4 steps)

  1. Gather the documents — the signed lease, and the move-in inspection if you have it, saved as PDF.
  2. Log in to MyMinfin with your eID or itsme, and open MyRent ("Have a lease registered").
  3. Fill in the online form (parties, property, rent, dates) and upload the PDF or PDFs.
  4. Submit. You receive a confirmation, and the lease now has a legally certain date ("date certaine").

You can also register by post at the competent registration office, but the online route through MyRent is faster and gives you an immediate record.

What happens if the lease is not registered?

This is where landlords get caught out. For a main-residence lease that the landlord has not registered, the tenant can end the lease without notice and without any termination indemnity — even during the first three years, when a registered lease would normally require three months' notice plus an indemnity.

And since 1 January 2025, the tenant no longer has to prove that they first put the landlord on notice to register. If the lease simply isn't registered, the exit right applies. The tenant is still expected to tell you they are leaving and to arrange the move-out inspection and the keys — but you cannot claim the usual notice or indemnity.

Does registration protect anyone besides the tax office?

Yes — it protects both parties, and especially the tenant. A registered lease has a "date certaine": if you sell the property, the new owner is bound by the existing lease and cannot simply evict the tenant. Without registration, the lease is far weaker against a new owner. Registration is not red tape for its own sake; it is what makes the lease fully enforceable.

Who pays to register the lease in Belgium?

Nobody: registering a main-residence lease is free when it is done within the two-month deadline. A cost only appears as a small fine if you file late.

Is the tenant responsible for registering the lease?

No. The obligation is the landlord's. The tenant may register it themselves at no cost, but is never required to.
